TERMS OF SERVICE

These Terms of Service (“Terms”) govern your access to and use of the Linkster mobile application, website, and related services (collectively, the “Platform”), operated by LinksterGolf LLC, a Wyoming limited liability company (“Linkster,” “Company,” “we,” “us,” or “our”). By accessing or using the Platform, you agree to be legally bound by these Terms. If you do not agree to these Terms, you may not access or use the Platform.

Linkster is a technology platform that enables users to connect with other golfers, organize or join golf events and meetups, participate in matches, buy and sell golf-related goods, offer or book lessons and clinics, and communicate with other users. Linkster is not a sports league, tournament organizer, golf instructor, retailer, employer, travel operator, or payment processor. Linkster acts solely as a neutral technology intermediary. Nothing in these Terms creates any agency, partnership, joint venture, or employment relationship between Linkster and any user.

You must be at least seventeen (17) years old, or the age of majority in your jurisdiction, to use the Platform. By using the Platform, you represent that you have the legal capacity to enter into a binding agreement. You are responsible for maintaining the confidentiality of your account credentials and for all activities conducted under your account. You agree to provide accurate and truthful information and not to impersonate any individual or misrepresent your identity.

Participation in golf activities, sporting events, lessons, clinics, and in-person meetups involves inherent risks. By using the Platform, you acknowledge and voluntarily assume all such risks. Linkster does not supervise, control, or guarantee user conduct. To the fullest extent permitted by law, you release and hold harmless LinksterGolf LLC from any claims arising from participation in any activity facilitated through the Platform.

Marketplace Policy

The Platform includes a peer-to-peer marketplace that allows users to buy and sell golf-related goods. Marketplace transactions are conducted solely between users. Linkster is not a buyer, seller, or party to any transaction and does not take ownership of any items.

Linkster does not manufacture, inspect, store, or ship items and does not guarantee the authenticity, quality, condition, safety, legality, or delivery of goods. All marketplace transactions are conducted at your own risk.

Marketplace transactions are additionally governed by Linkster’s Buy, Sell & Return Policy, which is incorporated by reference into these Terms. By engaging in marketplace activity, you agree to that policy.

Linkster disclaims all warranties related to marketplace items, including merchantability, fitness for a particular purpose, authenticity, and condition.

Linkster may collect service fees in connection with marketplace transactions. Such fees may be non-refundable, including in cases of returns, refunds, or disputes, except where required by law. Taxes, shipping costs, and processing fees may vary based on transaction details.

Users are solely responsible for complying with all applicable laws and tax obligations related to marketplace activity.

The Platform may also allow instructors or golf professionals to offer lessons or clinics. Linkster does not employ instructors or guarantee instruction quality. Participation is at your own risk.

Payments may be processed by third-party providers such as Stripe. Linkster is not responsible for payment processing issues, including disputes or chargebacks.

You agree not to use the Platform for unlawful or harmful purposes. Linkster may suspend or terminate accounts at its sole discretion.

You retain ownership of content but grant Linkster a license to use it in connection with the Platform.

The Platform is provided “AS IS” without warranties. To the fullest extent permitted by law, Linkster shall not be liable for any indirect or consequential damages. Total liability is limited to the greater of $100 or the amount paid by you in the past 12 months.

You agree to indemnify Linkster from claims arising from your use of the Platform.

Any dispute, including those related to marketplace transactions, returns, or refunds, shall be resolved through binding arbitration on an individual basis in Wyoming. You waive any right to a jury trial or class action.

These Terms are governed by Wyoming law. Linkster may update these Terms at any time.

BUY, SELL & RETURN POLICY

Effective Date: April 1, 2026

This Buy, Sell & Return Policy (“Marketplace Policy”) governs all marketplace transactions conducted through Linkster and is incorporated by reference into Linkster’s Terms of Service. In the event of any conflict, Linkster reserves the right to interpret and enforce both documents at its sole discretion.

Linkster acts solely as a neutral technology platform and is not a buyer, seller, or party to any transaction. Linkster does not take ownership of items and does not guarantee delivery, condition, authenticity, quality, or legality. All transactions occur directly between users and are conducted at your own risk. All sales are final unless a return is properly requested and approved under this policy.

Linkster charges a seller fee of 7.5% (minimum $2.75), deducted from proceeds. Taxes, shipping, and processing fees may vary. Certain fees may be non-refundable.

Sellers are responsible for accurate listings. Buyers are responsible for reviewing listings. Linkster may require evidence for disputes.

Returns must be initiated within seven (7) days of delivery. Items must be returned in the same condition with all components. Returns must follow in-app instructions. Buyers must use trackable shipping. Failure to return within the required timeframe may result in denial. Linkster is not responsible for lost or damaged return shipments.

Refunds are issued only after approval and verification of the returned item and are processed to the original payment method.

Returns are not eligible if outside the return window, missing components, materially altered, or marked final sale.

Linkster reserves sole and final discretion over all return, refund, and dispute decisions. Users initiating chargebacks outside the platform may face account suspension.

Linkster may hold payouts during return windows or disputes and may restrict accounts for abuse or fraud.
